Second Circuit Rules ExxonMobil Subsidiary Must Comply With FSIA in Order to Enforce $188 Million ICSID Arbitration Award in U.S.

The United States Court of Appeals for the Second Circuit has ruled that an ExxonMobil Oil Corporation subsidiary may not enforce a $188 million International Center for Settlement of Investment Disputes (“ICSID”) arbitral award against the Venezuelan government in the United States without first complying with the notice requirements provided for in the Foreign Sovereign Immunities Act (“FSIA”).

ICSID Orders Ecuador to Pay $380 Million to U.S. Oil Exploration Company Over Investment Treaty Violations

An International Centre for Settlement of Investment Disputes (“ICSID”) arbitration tribunal has ordered the Republic of Ecuador to pay a ConocoPhillips wholly-owned subsidiary nearly $380 million related to Ecuador’s breach of a bilateral investment treaty (“BIT”) with the United States.

Houston-Based Oil Co. Withdraws Request for ICSID Arbitration Against Venezuela

A Houston-based oil and gas company has withdrawn its mid-January request for arbitration before the International Centre for Settlement of Investment Disputes (“ICSID”). On January 16th, Harvest Natural Resources, Inc. reportedly asked the ICSID to consider its case against the Government of Venezuela in an effort to protect its 32 percent stake in the Petrodelta joint oil and gas venture.

ConocoPhillips Seeks ICC Arbitration Against Venezuelan State Oil Company

ConocoPhillips has reportedly filed for arbitration against the Venezuela state oil company, Petroleos de Venezuela (“PDVSA”). According to ConocoPhillips’ request to the International Chamber of Commerce (“ICC”), PDVSA failed to pay the company the contractual compensation owed to it over the Petrozuata and Hamaca heavy crude oil projects.
