Proposed Federal Laws Would Bar Certain Mandatory Pre-Dispute Arbitration and Class Waiver Agreements

On February 28th, Georgia Representative Hank Johnson and Connecticut Senator Richard Blumenthal introduced legislation that would prohibit pre-dispute mandatory arbitration clauses in employment, consumer, antitrust, and civil rights cases, but allow parties to agree to arbitration in the event a dispute arises.

Texas AG Joins Bipartisan Group Urging Congress to Act on Mandatory Arbitration of Workplace Sexual Harassment Claims

The Texas Attorney General has reportedly joined a bipartisan group comprised of representatives from 56 states and U.S. territories in a call for federal legislation that would prohibit employers from requiring victims of workplace sexual harassment to engage in mandatory arbitration.

SCOTUS to Hear Oral Argument Over Constitutionality of Inter Partes Review of Patents on Monday

On Monday, the United States Supreme Court will hear oral argument in Oil States Energy Services, LLC v. Greene’s Energy Group, LLC, et al., No. 16-712.  In the case, the nation’s highest court will consider whether the controversial process that is currently used by the United States Patent and Trademark Office to analyze the validity of and cancel existing patents is constitutional.

Senate Narrowly Votes to Rescind New CFPB Arbitration Rule

The Vice President has cast a tie-breaking vote in the United States Senate to rescind a new Consumer Financial Protection Bureau (“CFPB”) rule that prohibits most financial service providers such as banks and credit card issuers from requiring consumers to sign mandatory arbitration agreements barring class-action lawsuits.

U.S. House Passes Measure to Repeal New CFPB Arbitration Rule

Yesterday, the United States House of Representatives voted 231 to 190 to repeal a new Consumer Financial Protection Bureau (“CFPB”) rule that prohibits most financial service providers such as banks and credit card issuers from requiring consumers to sign mandatory arbitration agreements that bar class-action lawsuits.

Congress Considers Arbitration Fairness Act of 2013

Earlier this week, Minnesota Senator Al Franken reintroduced legislation aimed at removing forced arbitration clauses from antitrust, consumer, and employment contracts. Amends the FAA by adding a new chapter invalidating agreements that require the arbitration of employment, consumer, civil rights, or antitrust disputes made before the dispute arises.
