Proposed Legislation Aimed at Preventing Surprise Medical Bills Approved by Texas Senate’s Committee on Business and Commerce

Yesterday, the Texas Senate’s Committee on Business and Commerce voted 7-2 to approve a substitute Senate Bill 1264 that was introduced in an effort to protect Texas patients from incurring surprise out-of-network medical bills.

Federal Appellate Court Orders United Healthcare, Physicians to Mediation

A federal appellate court in New York has reportedly ordered a dispute between United Healthcare and two county medical societies to mediation. The lawsuit arose in October 2013 after the insurer removed thousands of doctors in Connecticut and other states from its Medicare Advantage network.

10th Circuit Holds FAA Preempts New Mexico Law in Nursing Home Dispute

The United States Court of Appeals for the 10th Circuit has held the Federal Arbitration Act (FAA) preempts a state law that states “a compulsory-arbitration provision in a contract may be unconscionable, and therefore unenforceable, if it applies only, or primarily, to claims that just one party to the contract is likely to bring.”
